Description

Keeping in mind the earlier argument, there are recognized laws existing in India on several methods of winding up. The principal fact of this research paper is to learning the laws and procedures of voluntary winding up under the Companies Act, 2013. This paper also challenges to analyse and relate the various requirements of winding under the under different countries Legislations. In the later part, the paper researches deep into making a relative study of the provisions laid down in the Companies Act, 2013 and thus attempts to scrap out the difference with the prevailing provisions under the Act. Further, this paper challenges to conclude by determining the precise variances and similarities in the two laws. This paper also includes the comparison study of how winding up procedure is different in companies Act in comparison to IBC, 2016
