Description

The research aims to compare and contrast the Fédération Internationale des Ingénieurs-Conseils (FIDIC) Conditions of Contract for Construction designed by the Employer (1999 – The Red Book) and Administrative Law 182 for the year 2018 in Egypt, with a focus on variations, delay damages, delayed payments, delayed drawings or instructions, adjustment of prices, and dealing with exceptional circumstances such as COVID-19. By analyzing these critical issues, the research provides new insights into how contracts in these conditions can be better administered. The research methodology is based on a descriptive statistics approach, which enables readers to understand the conflicted clauses/articles of the aforementioned issues. The findings indicate that the formulas for adjustment of prices provisions were the only provisions that do not impose many contradictions between FIDIC 1999 Red Book and Law 182 for the year 2018. Overall, this research provides valuable contributions to the field of construction contracts and highlights the need for greater consistency and clarity in contract drafting and administration.
