This dataset is part of a doctoral research project titled “Rights and Obligations of Spouses Against Each Other According to the Law Approved in Iran & U.S.” It contains the full legal-analytical manuscript examining and comparing the financial and non-financial rights of spouses under the legal systems of the Islamic Republic of Iran and the United States. Topics discussed include marriage, divorce, custody, maintenance, mahr (dower), nafaqah (spousal support), and marital property rights. The research offers a critical analysis of the Iranian family law framework, highlighting its outdated, jurisprudence-heavy structure, which often contradicts the needs of modern Iranian families and fails to reflect their social and cultural realities. In contrast, U.S. legal developments provide reform-oriented insights that are explored comparatively. The manuscript provides detailed legal reasoning, statutory interpretation, and suggestions for harmonization and reform. This dataset is intended for use by legal scholars, practitioners, policy makers, and students specializing in family law, comparative law, and private law. Steps to reproduce
This research was conducted using comparative doctrinal legal analysis. Primary sources included Iranian civil codes, constitutional provisions, judicial decisions, and legislative commentary. U.S. sources included case law, statutory materials, and constitutional norms from selected jurisdictions. The research methodology is qualitative and analytic, without the use of empirical or numerical data. The manuscript reflects a structured comparison between the outdated and rigid family law framework in Iran and the more adaptive legal standards found in U.S. family law. No proprietary software or datasets were used; all legal materials cited are publicly available.
